Proceeding and Challenge of Environmental Right Protection Under the “Dual Carbon” Goals

Abstract: The report of the 20th Party Congress proposed that " Working actively and prudently toward the goals of reaching peak carbon emissions and carbon neutrality. Based on China’s energy and resource endowment, we will advance initiatives to reach peak carbon emissions in a well-planned and phased way in line with the principle of building the new before discarding the old." In order to implement the “dual carbon” goals, the Chinese government has taken a series of active initiatives in emission reduction, adaptation, market and finance to address climate change in 2022. Local governments have been formulating local policies to implement the dual carbon goals, and vigorously promoting new progress in environmental right protection. At the same time, it is also noted that in the concrete implementation of the “dual carbon” goals, there are still obstacles of insufficient central legislation, lack of judicial protection, and stereotyped administrative measures, and thus it is recommended that a human rights perspective be fully integrated into the implementation of the dual carbon goals for addressing climate change.
