Abstract: The modernization of ecological environment governance adheres to the principle of harmonious coexistence between humans and nature, with the aim of protecting the "community of life between humans and nature", reflecting on the traditional legal theory of "subject-object dichotomy",reconstructing the legal relationship between "humans-nature-humans", and using the means of the rule of law to protect the realization of human rights.Based on the distinct human rights characteristics reflected in the structure of rights, social functions, and subject elements of environmental rights, the new era of environmental human rights aims to meet the growing needs of the people for a better ecological environment, showcasing China's new stance on developing a new generation of human rights and ecological civilization construction. It is also an emerging right born in the practice of environmental rule of law, which is reflected in ecological environment legislation, law enforcement，environmental justice，and law-abiding，throughout the operation of the rule of law, it has been demonstrated.
