On the Relations between Whole-process People’s Democracy and Legal Protection of Human Rights

Since the 18 th National Congress of the CPC, the Party and the government have prioritized the respect for and protection of human rights in the governance of the country, and kept advancing the whole-process people’s democracy and the legal protection of human rights. Under the common requirement of “commitment to the organic unity of Party leadership, the running of the country by the people, and law-based governance”, the advancement of both the whole-process people’s democracy and the legal protection of human rights along the path of human rights development in China has turned out to be interactive. On the one hand, the former lays an underlying democratic political basis and a basic institutional foundation for the latter and bases the latter on the socialist democratic politics with Chinese characteristics such as the system of people's congresses. This fully reflects the affinity to the people, which is most particular to human rights development in China. On the other hand, the latter further promotes the realization of the former by facilitating people’s full access to civil, political, economic, social and cultural rights through legislation, law enforcement and administration of justice and practicing democratic election, democratic consultation, democratic decision-making, democratic administration and democratic supervision by law. China should pay special attention in further carrying out the whole-process people’s democracy through legislation, law enforcement and administration of justice. First, it’s necessary to protect people’s democratic rights thoroughly and comprehensively. Second, it’s important to actively respond to people’s needs of a better life and safeguard citizens’ personal right, property right and personality right as well as their economic, cultural, social and environmental rights.
